COMPLETION OF TASKS RELATED TO EURO 2012 BY THE BORDER GUARD
The Border Guard shall be mainly responsible for ensuring an effective and efficient control on EU external as well as internal borders.
We expect incoming supporters from other countries, which makes it necessary to take the following measures:
- performing an effective control of organised groups on road lanes specially selected for this purpose and newly built border crossing points. At the moment, the Border Guard operates in 130 locations and ensures the border traffic control on 282 border crossing points. On the EU external border it fulfils its tasks on 71 border crossing points: with Russia - 6, Ukraine,- 12 Belarus - 13, sea border - 20 and airports - 20. The Commission for Border Crossing Points and Infrastructure of the Polish-Ukrainian Intergovernmental Coordination Council for Interregional Cooperation recognised as its priority to establish a road border crossing point Malhowice - Niżankowice on the Polish-Ukrainian border designed for vehicles with maximum permissible total mass to 3.5 tons which may be extended to 7.5 tons (no crossing for pedestrians). In the Resolution No. 42/2007, the Council of Ministers gave its approval for binding Poland by the agreement concluded with Ukraine in respect of establishing border crossing points on the Polish side. Furthermore, Polish and Ukrainian delegations determined that first road border crossing points to be established are the following ones: Budomierz - Hruszew, Dołhobyczów - Uhrynow and Malhowice - Niżankowice (infrastructure to be located on the Polish side of the border) as well as Zbereże - Adamczuki (infrastructure to be located on the Ukrainian side of the border). Any matters relating to the construction start-up of the above border crossing points are the competence of relevant Governors of Provinces. It was found reasonable to discuss the possibility of establishing additional new border crossing points: Mszaniec - Banriw, Dubienka - Kładniw, Kryłów - Krecziw, Wołosate - Łubnia.
On the internal borders, the Border Guard shall fulfil its tasks as long as the control on 211 border crossing points has been stopped. This includes the following number of internal border crossing points: with Lithuania - 4, Slovakia - 58, Czech Republic - 111 and Germany - 38.
- preventing unwelcome visitors and potentially dangerous individuals constituting risk to public security and order from entering the country. The basis for using the procedures of refusing foreigners to enter EU during EURO 2012 shall result both from the EU regulations and domestic legal regulations. In 2012, the Border Guard shall work with the use of the Schengen IT System whose operation principles were specified in the Executive Convention to the Schengen Treaty. Furthermore, the basis for refusal to enter EU were specified in the foreigners act in the case of citizens of third countries as well as in the act on entering the territory of Poland, stay and leaving this territory by EU citizens and their family members.
Consultations as regards issuing visas for foreigners from the increased risk countries will be held based on the VIS (Visa Information System).
- ensuring security control in international communication, in particular as regards air transport in order to exclude the possibility of terrorist acts,
- supporting activities of the Border Guard organisational units on selected parts of the country border by providing additional forces and funds.
The prerequisite condition for efficiency of these activities will be close cooperation with Ukrainian border services as well as with border and police forces from other countries participating in the European Football Championships by means of:
- exchange of information with Border Plenipotentiaries of neighbouring countries on planned arrivals of supporter groups and technology of border check-in and possible dangers,
- involvement of liaison officers from border services in cooperation to determine places and mode of effective control and way of disseminating information,
- using contact points on the internal border and consultancy points on the external border for exchanging information,
- submitting data to the operation general office as regards any individuals checked during the border control who may constitute a danger to public security and order.
In 2012, Poland will use all Schengen acquis. As a result, controls on internal borders with other Schengen countries will be lifted. To increase security during the European Football Championships, based on the risk and estimated danger analysis, it will be possible to reintroduce controls on internal borders using the existing infrastructure of border crossing points as well as organising moving controls on routes leading to borders.
The basis for reintroduction of controls as well as conditions of use and duration were specified in chapter II title III of the Regulation of the European Parliament and the Council of 15 March 2006 establishing a Community Code on the rules governing the movement of persons across borders. Border controls on internal borders shall be reintroduced in situations of danger to public security and order by notifying other EU member states of such situations.
Apart from the above mentioned tasks, the Border Guard shall cooperate with the Police on many levels such as:
- joint use of resources and measures to perform controls on roads leading to the country borders, patrolling stations, securing trains with supporters and protecting communication centres and routes,
- monitoring movements of supporters and any individuals who may constitute a danger to public security and order,
- organising joint actions, training, simulations of exercises on regaining public order to elaborate optimal and most effective forms of action.
