Below data refer to cases, which received or should received (in opinion of the General’s Prosecutor Office (former: the National Prosecutor’s Office) legal qualification from articles that punish the crime of trafficking in human beings.
As a result of the change in the process of collection of data in 2009, these data was divided into two periods: 1995-2008 and 2009-2010:
- Data for 1995-2008 refer to the crime of trafficking: the crime from Article 253 (1) of the Penal Code (trafficking) and Article 204 (4) of the Penal Code (enticing or abducting another person with the aim of having him/her engage in prostitution abroad) and additionally crimes from Article 204 (1) of the Penal Code (impelling another person to prostitution of facilitating it in order to gain material benefits), Article 204 (2) of the Penal Code (gaining material benefits from prostitution of another person), Article 204 (3) of the Penal Code (committing the crimes pointed in Articles 204 (1) and 204 (2) against minor) and Article 203 of the Penal Code (leading another person to prostitution by means of violence, unlawful threats, deceit or by taking advantage of the dependency or critical position);
- Data for 2009 refer to the crime of trafficking: the crime from Article 253 (1) and Article 204 (4) of the Penal Code and additionally from Article 204 (3) and Article 203 of the Penal Code;
- By analogy, data for 2010 refer to the crime of trafficking: the crime from Article 253 (1) and Article 204 (4) and Article 189 a (as a result of the amendment of the Penal Code which entered into force on 8th of September 2010) and additionally from Article 204 (3) and Article 203 of the Penal Code.
